Shot, Silenced, and Smeared: One Physician’s Ordeal with Abuse of Process and his Continued Fight to Clear his Name

The criminal case People v Gosselin took place in a little red house structure known as the “Town of Highland Justice Court” located in Sullivan County, New York. This little red structure is also known as the Barryville Town Hall, where court is conducted one time a week – if at all. On Wednesdays, locals, for two hours, can see one of two judges take the bench between 5pm and 7pm. One of these two judges, and the investigation that he was a “part of”, represented a conflict of interest and is captured in this article – and they are devastating details.

What has taken place in the small courthouse involves Dr. Paul Gosselin, who committed no crime. He was not bothering anyone, not armed, not intoxicated, and had no felony record. A licensed physician and veteran with PTSD, he had dedicated his career to caring for patients in underserved communities. Yet on an ordinary day in a small New York town, he became the target of a false police narrative that nearly cost him his life — and revealed how far the machinery of justice can be perverted.

From COVID Target to Police Target

Dr. Gosselin was already under fire for his medical conscience. During the COVID crisis, he was the first physician in the country targeted for so-called “misinformation.” His offense? Treating patients outside the pharmaceutical script and writing exemption letters for those who declined experimental injections. For this, he endured an eight-month suspension of his medical license.

Local papers piled on, publishing false reports that his license had been “revoked in Massachusetts.” In reality, this was a blatant lie; his license was never disciplined in Massachusetts. Dr. Gosselin remained a fully licensed physician in Maine until the day a rogue cop’s shotgun changed everything.

The Government’s Allegations vs. The Truth

The chain of events began when one officer falsely claimed that Dr. Gosselin was “an irate man with a firearm.” No gun was ever present or recovered. One of the last officers rushing to the scene is heard over the radio, “Watch crossfire.” The following is the critical sequence of events:

14:38:05 Upon hearing the first phrase, “Cross Fire!”, Paul moves to avoid the incoming rounds and is heard screaming. The local Constable steps off the road into the grass.

Paul Gosselin’s car windows were all down, and as these threats of imminent danger rang out, he attempted to avoid the incoming rounds. A moment later, the NY State Trooper fired a 12-gauge slug into Gosselin’s back and shoulder, as the assisting Constable stepped back to avoid the incoming rounds, a second shot blasted through his car door.

Thirty officers on scene did not fire. The assisting Constable was the closest officer with a clear view, and he did not fire. Yet one man pulled the trigger — and nearly killed an innocent physician. Dr. Gosselin required massive blood transfusions and emergency surgery; his injuries were strikingly similar to the recent shooting of public figure Charlie Kirk.

As he bled, the EMT team inexplicably delayed medical evacuation for nearly 90 minutes. The head EMT on the scene was also the town judge — a retired NYPD officer who later presided over the criminal case. Despite this blatant conflict of interest, he refused to recuse himself for more than a year.

From Victim to Political Prisoner

Instead of being treated as a victim of police violence, Gosselin was charged with attempted murder of a peace officer and assault with a vehicle. The facts tell a different story:

    • He was speaking calmly with an officer, offering to help him get home.
    • He moved only after the threat of “CROSS FIRE – CROSS FIRE!!!” was heard — an act of reflexive self-preservation, not aggression, and the Constable was not in the path of his car.
    • No firearm was found, because none existed.

Despite this, he was jailed for four months. Incarcerated without due process, he endured death threats, assaults, and torture-like conditions. Local media parroted the false narrative, claiming he “tried to run over a police officer.”

Abuse of Process, Malicious Prosecution

The charges against Gosselin were not about justice. They were about covering up a rogue cop’s misconduct, silencing a victim, and shielding the town from liability by running out the clock on civil claims.
In New York law, that is abuse of process: using the machinery of justice for illegitimate ends. It is also considered malicious prosecution; which involves pursuing baseless charges with malice and without probable cause.
The New York Court of Appeals has long recognized that when legal process is twisted to achieve collateral goals, it is itself an injustice. Gosselin’s case is a textbook example.

    Paul is a professional physician; a great Christian brother and friend, who cares for the well-being of his friends and patients. He believes in natural medicine instead of chemically poison vaccines or prescription that harm/kill people. Paul has a heart of gold and his goal is make people healthy. It is sad what those police did to him for what he believes in. Our justice system is screwed up. I believe they were racist And they should be held accountable for their actions. Paul was an innocent man, and he was in the wrong place at the wrong time because these people were looking for someone to shoot. Shame on them Paul you are a winner and they are losers. Fight the good fight because you are in the right We stand behind you

    I have known Dr Gosselin for several years he is a caring and compassionate physician.I have seen him treat patients that are less fortunate financially , for eggs from their farm because they could not afford health care elsewhere. This is how we treat our Veterans that may be in need of assistance. Assault them when they ask for help, then try to demonize them after to justify it. It’s BS the cop made a bad decision it’s evident . Own up to it and face the consequences. It’s called accountability

    Wow, just more judicial system corruption and cover-up! Police blatantly lying about the circumstances where deadly force was absolutely not warranted and the EMT on the scene was the judge??? Are you serious?? And why did the police turn the audio off? What kind of lies were they cooking up? And why did they delay getting help medical help so long? Were they hoping he’d just die so they could bury their lies with him? Absolutely disgraceful! All this and they’re still trying to put him back in jail. Unbelievable.

    I’m glad to finally get the true story about what happened. From everything I heard it wasn’t even close to what is was relayed in this article. The police should be held to account for attempted murder and there should be a massive lawsuit. Paul is a good man and was my physician. He has great heart which I wish everyone could see.
