A Holden man with a troubling criminal history is back in custody after a domestic violence incident, raising questions about why he wasn’t behind bars serving his sentence.

David MacKenzie, 52, was arrested Wednesday night after police responded to a 911 call from an upset woman around 9:15 p.m. Holden Police said in a Facebook post that MacKenzie was charged with domestic violence assault, operating after suspension, and violation of conditions of release.

Just months ago, in August, MacKenzie was convicted of four felony charges related to a hit-and-run incident that left 87-year-old Ira Williams of Brewer injured. Prosecutors said MacKenzie was impaired when he struck Williams with his vehicle, fled the scene, and hid the car at his Holden home.

In October, MacKenzie was sentenced to six years in prison, with all but 15 months suspended, followed by three years of probation and a six-year license suspension.

Despite this, MacKenzie was out on post-conviction bail, leaving authorities and the public questioning why he wasn’t serving his sentence.

This marks the second case in two months where a suspect expected to be in prison was arrested for new offenses.

Last month, Christopher Webber was nabbed in Brewer with enough fentanyl to kill 20,000 people.

Webber, convicted of aggravated drug trafficking, was inexplicably out on bail under house arrest before completing his sentence, per the Holden PD.
