Nearly 100 Illegal Aliens on Terrorist Watchlist Released into US Under Biden-Harris Admin: House Judiciary Report

Nearly 100 migrants on the terrorist watchlist were released in the United States after illegally crossing the southern border under the Biden-Harris administration, according to a report released Monday by the House Judiciary Committee.

According to Department of Homeland Security (DHS) data provided to the Republican-led House Judiciary Committee, between 2021 and 2023, of the more than 250 illegal aliens on the Terrorist Screening Dataset (TSDS) — also known as the “watchlist” — that were encountered by Border Patrol at the southwest border, 99 were released into the U.S.

At least 34 of the illegal aliens on the terrorist watchlist encountered by Border Patrol under the Biden-Harris administration are in DHS custody, but not yet deported from the U.S., the report states.

Additionally, the report cites DHS data indicating that so far during fiscal year 2024, Border Patrol has encountered tens of thousands of illegal aliens from countries that could present national security risks — including 2,134 Afghan nationals, 33,347 Chinese nationals, 541 Iranian nationals, 520 Syrian nationals, and 3,104 Uzbek nationals.

There has been a more than 3,000 percent increase in the number of border encounters with watchlisted illegal aliens since President Biden took office in 2021, the report found.

“That does not include the untold numbers of potential terrorists that evaded Border Patrol to enter the United States as part of nearly 2 million ‘gotaways’ since the beginning of the Biden-Harris Administration,” the report says.

The Judiciary Committee report also sheds light on the case of the eight Tajikistan nationals with potential ISIS ties that were arrested in major cities across the country by U.S. Immigrations and Customs Enforcement (ICE) earlier this year.

The report found that of the eight Tajik nationals, three were released into the country after using the Biden administration’s CBP One phone application to schedule an appointment at a port of entry.

This revelation casts doubt on the testimony DHS Secretary Alejandro Mayorkas from a Congressional hearing last year in which he claimed the CBP One app program “[a]llows [DHS] to screen and vet individuals before they arrive at our border.”

Potential loopholes related to the use of classified information in immigration court proceedings were discussed in the report as an area of major concern regarding watchlisted migrants being released into the U.S.

In a transcribed interview with the committee, Chief Immigration Judge of the Justice Department’s Executive Office for Immigration Review (EOIR) Sheila McNulty admitted that only about five percent of immigration judges are able to access top secret information.

McNulty conceded to the committee that she “imagine[d] there may be” gaps in the information DHS provides to immigration judges regarding an illegal alien’s potential danger to the community or flight risk.

Monday’s House GOP interim staff report comes as Republicans seek to highlight the failure of vice president and presumptive Democratic presidential nominee Kamala Harris in her role as the current administration’s point person on handling the illegal immigration crisis at the southern border.

“Although American communities already feel the disastrous effects of the Biden-Harris Administration’s immigration policies, the worst could still be yet to come,” the report claims.

“With national security experts and immigration officials increasingly concerned about the threat of terrorism originating from the border, it is clear that policymakers must take all necessary steps to secure the border and stop the flow of illegal aliens. However, the Biden-Harris Administration has refused to address the national security nightmare created by its radical, open-borders agenda,” it stated.
